Introduction

Welcome to Steed Cycles! These Terms and Conditions govern your use of our website, steedcycles.in, and the purchase of our products. By accessing our website and/or purchasing our products, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please refrain from using our website.

These terms and conditions are applicable and binding on any user/visitor/prospective customer (individual user or company/firm) of Ceeyes Mobility Solutions Private Limited, who accesses or uses https://www.steedcycles.in to make the payment of the full booking amount against the specific colour and model of Steed Dynamics Bicycles (Hereinafter Mentioned as Steed OEM).

General Conditions

1. Eligibility: You must be at least 18 years old to use our website and purchase products. By using our website, you represent and warrant that you meet this age requirement.
2. Account Information: You agree to provide accurate and complete information when creating an account or making a purchase. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Prohibited Uses: You may not use our website for any illegal or unauthorized purpose. You agree not to transmit any worms, viruses, or any code of a destructive nature.
4. Language Proficiency: The User hereby agrees, acknowledges, and confirms that the User can understand, read, and write in the English language; and has read, understood, and agrees to be bound by these clickable Terms.

Product Information

1. Product Descriptions: We strive to provide accurate descriptions of our products. However, we do not warrant that the descriptions are complete, current, or error-free. If a product offered by us is not as described, your sole remedy is to return it in unused condition.
2. Pricing: All prices are subject to change without notice. Prices for our products are quoted in the local currency and include applicable taxes. Shipping and handling charges will be added to your total order.
3. Availability: We do our best to maintain the availability of our products. However, we cannot guarantee that any product will be in stock at all times. We reserve the right to discontinue any product at any time.

Orders and Payment

1. Order Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud.
2. Payment: Payment must be made at the time of order. We accept various payment methods as indicated on our website. By providing payment information, you represent and warrant that you are authorized to use the payment method.
3. Order Confirmation: After placing an order, you will receive an email confirming your order. This email does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order.

Limited Warranty

Subject to the following limitations, all bicycles manufactured by Ceeyes Mobility Solutions Private Limited are warranted to the original purchaser to be free of defects in materials and workmanship for a period from the date of purchase:

• 5 years for the Propeller Shaft Drive System and 1 year for the Belt Drive System.
• 5 years for the Al Alloy Frame & Alloy Rigid Fork and 2 years for the Steel Frame.
• 1 year for Steel Rigid Fork, Internal Gear Hub, CMS Alloy Hubs, Alloy Rims, and Pedal Arms.
• 6 months for the normal Steel Suspension Forks and 1 year for the Alloy Mechanical and Hydraulic Suspension Forks.

No other express or implied warranty is given. Ceeyes Mobility Solutions Private Limited will replace without charge the bicycle frame, fork, or parts that are determined by the company to be defective in materials or manufactured under normal use and service during the applicable warranty period. The original purchaser will be responsible for any labour charges connected with the repair or replacement of the frame, fork, and/or parts. Parts subject to wear in use (tires, tubes, seats, grips, and brake shoes) are not covered under this warranty.

Caution:

This limited warranty does not apply to normal wear and tear, or to claims for defects, malfunctions, or failures that result from abuse, neglect, improper assembly, improper maintenance, alteration, collision, crash, or misuse. The bicycle frame, fork, and parts have not been designed, engineered, manufactured, distributed, or retailed for use in trick riding, ramp riding, jumping, aggressive riding, riding on severe terrain, riding in severe climates, riding with heavy loads, commercial activities, or any similar activities; such uses may damage the bicycle frame, fork, and/or parts, can cause serious injury to the rider, and in all cases will void this warranty.

Bicycle riding can be inherently dangerous such that bodily injury or death can occur, especially if the rider does not make the safety and maintenance checks recommended in this manual if the rider does not wear a helmet, if the rider does not follow the rules of the road, if the rider goes into traffic, rides double, or engages in aggressive stunt or extreme terrain riding. Riders taking such actions will assume their own risk of injury and Ceeyes Mobility Solutions Private Limited will not be responsible.

THE PURCHASE OF THIS BICYCLE WILL CONFIRM THE BUYER’S AGREEMENT THAT CEEYES MOBILITY SOLUTIONS PRIVATE LIMITED’S LIABILITY UNDER THIS WARRANTY SHALL BE NO GREATER THAN THE AMOUNT OF THE ORIGINAL PURCHASE PRICE AND IN NO EVENT SHALL CEEYES MOBILITY SOLUTIONS PRIVATE LIMITED BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.

Limitation of Liability

To the fullest extent permitted by law, Ceeyes Mobility Solutions Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use our website or products; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; and (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website.

Governing Law

These Terms and Conditions are governed by and construed by the laws of the jurisdiction in which Ceeyes Mobility Solutions Private Limited is headquartered, without regard to its conflict of law principles.

Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our website following the posting of changes constitutes your acceptance of those changes.

Communication

The User agrees, understands, and acknowledges that transmission of information through the Internet is not a secure means of sending information and the same may be subject to tampering and unauthorized access, fraudulently or mistakenly written, altered or sent, and not be received in whole or in part by the intended recipient and which may affect the availability and performance of this online facility provided by Ceeyes Mobility Solutions Private Limited. Accordingly, the User shall not hold Ceeyes Mobility Solutions Private Limited liable for any loss/damage, whether direct or indirect, arising out of or resulting from such tampering and unauthorized access, fraud, mistakes, etc.

The User authorizes Ceeyes Mobility Solutions Private Limited to exchange or share information and details relating to the User’s booking of the Steed Chainless Bicycle with the Dealership, other third-party agents/representatives as may be required or as it may deem fit for facilitating the booking and/or related offerings or other products/services that the User may apply for from time to time. The User agrees and confirms that the User shall not hold Ceeyes Mobility Solutions Private Limited (or any of its group companies or its/their agents/representatives) liable for the use/sharing of such information.

The User understands that by sharing the User’s contact information, the User hereby provides consent for receiving communications from Ceeyes Mobility Solutions Private Limited, its group companies, and agents/representatives about the Steed chainless bicycles, including promotional communications through any mode (including without limitation through telephone calls/SMSs/WhatsApp/emails). The User confirms that the User shall not challenge receipt of such communications as unsolicited communication, defined under TRAI Regulations on Unsolicited Commercial Communications.

The User understands and undertakes to keep the User’s credentials, including order details/booking information, as confidential and shall not share the same with any third party. Any use or misuse of the same, including the transactions carried out, shall be the sole responsibility of the User, and Ceeyes Mobility Solutions Private Limited shall not be held responsible for any loss/damage incurred on account of such use, misuse, and/or transactions.

All parties shall ensure the compliance of the applicable provisions of the Information Technology Act, 2000, and its allied rules as amended from time to time. Ceeyes Mobility Solutions Private Limited shall not be responsible for any failure on the User's part to comply with these provisions.

Indemnification

The User agrees to defend, indemnify, and hold Ceeyes Mobility Solutions Private Limited harmless from and against any claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to the User’s use of the Platform.

Use of Platform

Unless otherwise specified, the Platform and its contents thereof are displayed solely to promote Steed Chainless Bicycles and accessories.

Jurisdiction

In case of any dispute relating to the transaction or any other matter arising from the use of this Platform, the same will be subject to the exclusive jurisdiction of the appropriate Court at Trichy.

Non-Acceptance

Non-acceptance of any of these terms and conditions will result in disqualification.

The offer to make a booking of the Steed Chainless Bicycle subject to these terms and conditions is optional, and the User may choose not to book the Steed in response to the offer.
